If i have an orginal (halo 3) for xbox live, Will i still get banned for having a hacked firmware drive?

you always have the chance of getting banned from live if you have messed with your console.
But that is the safest way.playing with a orig game with flashed firmware should be fine
I do it all the time.

so the only time i play on live is with the other guys that come to game night on Saturdays.
There will 5-10 of us messing around.
