ok here goes,i happened across some of these themes.
i came across this on how to put them on your 360 hdd
here goes
1.Connect your XBOX hard drive to your PC and explore it with a Xplorer360
2.Place the contents of the file 0000000000000000 in partition 3,then in the directory 0000000000000000
The themes are installed, just go to my Xbox,
then second tab (your Gamer Tag in fact) and select: Change the theme

If it were signed, you wouldn't be able to use them period. They wouldn't even show up as an option to change from your current them to the new ones.
I don't know if you can get banned with doing this or not though. Hard to tell.

I have a couple of friends that download DLC and put into their hard drive. None banned so far

Hello guys i hope i can shine some light in this topic.
Those themes are from the OXM disk that comes with the xbox magazine.
Content from the disks aren't signed to a console, in other words i guess your free to share them
DLC like from Fallout 3 (Operation Anchorage + The Pitt) which was released on disk can be shared without paying
Since its not console signed you can get content off the harddrive or disk and upload it somewhere. However you manage to receive it, you simply put it in the correct folders and SHA-ZAM! FREE DLC
This also works for GTA 4's:
Lost and Dammened (the one on disk)
and its upcoming Ballad of Gay Tony (the disk one)
So What does this mean?
Simple, stuff from disks can be shared!!!!!

Also there are programs designed to "resign" info like this. Even previously attached stuff, like DLC and the like. It's still considered very dangerous though as there's no real way to know what M$ looks for when they are scanning the systems.
