Question about my gamertag

OK..SO I got banned on my modded console. I didnt get an email from MS, so I am assuming that my gamertag isnt banned. So I am buying a new CODMW2 special edition console tomororw that has a new 250gig HD..I really only want my gamertag to follow me to the new console, for my achievements and such before the ban.. I dont care about old game saves. I also figure I can redownload the few Live games I had purchased.
Is this something I can do after plugging the new console into the internet when I get home? Is this safe to do since my gamertag was used on a console that is now banned?
Has anyone tried this and been successfull? Is this safe?

Thanks guys, im just paranoid that I am about to spend 400 dollars on a new console, and I dont want it to somehow get banned because of my gamertag...I will not MOD this one for sure!

the gamertag is fine, the only thing that got banned was the console. when you get the new 360 you can recover you're gamertag on to it. . .

Modded xbox = ban
Non-Modded xbox = No ban

What you should do is transfer your content licences to your new HDD, that way you dont need to be connected & signed into live when you want to access any of your XBLA games, or your games on demand titles...

haggardsmurf...Cant i just redownload these files once connected to Live? Its really only 2 games and the xvid codec pack...

You can redownload them but your console wont be licenced to use them which means you will need to be signed into your gamertag in order to play the games, and use the codec pack.

For me, its a pain in the ass to be signed in for the codec pack.
