I would like a better way of determining if games do the new checks. Fable III? Black Ops? Wave 7/8/9?
@bsammy: I wouldn't recommend updating if you don't have a kinect. The new dash is hideous! It looks like a text file. Not sexy.

I for one was waiting to update my elite BenQ with FW Lt 1.2 until the new FW came out but it seems kids couldn't wait for the Kinect.So I updated to new dash 2 days ago and everything seems fine.I played Back Ops last night for about 3hours with no problems.Just turned on 360 and no problems.I am staying away from the newer games besides Black Ops
From the research I have done seems Black Ops does not do ap25 check,as of right now.I wouldn't update unless you have kids nagging you about getting the Kinect.If our 360 gets banned I am taking my kids allowance for 3 weeks to buy a new 360

im still online too (orig codbo tho) with new dashboard and all my old backups still fine and unflagged using Xval......long may it last iv been banned twice in 3 yrs
stayed clear of getting fable3 (not my ting anyway-lucky)

If anyone's worried about the update i would go back to stock also my friend has been on black ops since it came out he has the original rip to the hard drive and using the backup to boot up he's been ok so far will let you's know if he gets banned

Just to put my 2 cents in. I've updated to the new dash and have been playing Black Ops since day one, hour one. So far so good. I'm running a lite-on 7000 series with lt 1.1. This is in no way saying that it's safe, but I've not been banned yet. I also have a second 360 running a benq/spoofed as a hitachi with lt 1.1 that has been updated as well and still no issues. I will let you know the moment I get banned, if I indeed do.

To, summarize: The AP2.5 checks are not on the disc in the normal sense; an AP2.5 game merely requests the check from the console. The check it self is implemented in the dashboard and drive firmware. Unfortunately, the article gets a little contradictory here. It says there's no way to determine if a game does the check without booting it. However, it also mentions that a tool called XexTool can check if a game will request the check.
*** Call of Duty: Black Ops DOES NOT do AP2.5 check! ***
*** Fable III DOES NOT do the AP2.5 check! The flag is present, but the value is not correct. ***
Also, it isn't mentioned in the link, but I've seen reports that Assassin's Creed: Brotherhood is doing the AP2.5 check. It forces the update to the Kinect dash.
