no the flash firmware
will NOT let you play on live for free.
all it does is let you play backuped games

oh ok gotcha thanx guys so i have to still pay for a membership to play online
once i pay my membership were i can play online can i play my backups online??

You can yeah ... but there is always a risk in doing so...
Not only with backup also with originals... because they sorta can see the drive firmware...
BUT if you flashed your drive good with the latest FW there should not be any problem ... Keep an eye out on here for reports of ban waves and updates from MS ...

as far as we know they have only picked up on bad backups.
if it was a firmware thing,when they sent out the ban hammer, it would have got all of us.instead of the few it did.
but over all
pluto is right if you are playing a backup on hacked firmware you can gt banned from live.

Nope. Once you are banned, that's it. Your only option at that point is buy a new 360 to play on Live.

the console will still work.
it will play games and movies.
the only thing it wont do is get on live if it gets banned

ok i flash mine so i have the call of duty4 i bought from the store can i play that online without getting banned

there no 100% sure way of not getting banned.
the safest way is to play orig games on live.
and make sure your backups are done right with all the stealth patches

yeah personally i don't play on live, but i think alot of guys on here do with ixtreme 1.4 an proper backups, and i don't think any of them have been banned ?
i'm not sure but i don't think they have.
i think the main risk to get banned is playing a faulty backup, aka downloaded iso or not ripped/burned properly.
