they (M$) send a response check to the disc
being that the firmware is modded the time the response takes (faster or slower is irrelevant)
is different than the orig
they can see that ,after many checks just to be safe that they are not banning a good console.
bang your banned
As I said earlier, my Benq made a very conspicuous sound 5 minutes before I got banned. It sounded like the RPM had been boosted to absolute maximum, but there must have been more to it cos I can honestly say the drive has never, ever made that noise before. It really caught my attention. Looking back, I am sure it was m$ performing this response check.

Pirates make death threats to Xbox 360 Director of Policy Enforcement Stephen Toulouse.
As has been reported, Microsoft has been cracking down on modded consoles for its Xbox 360. This weekend, angry pirates threw loose threats at Stephen Toulouse the director of Policy and Enforcement for Xbox Live. Pressed with phone calls where threats toward himself, wife, and pets were made. Toulouse made an appearance on a IRC channel to ask the pirates to stop calling him and that all threats had been passed on to law enforcement.
Here's a copy of the trancript from the IRC channel #360banned

nimda0 wrote:Now, if you do get banned... YES you can get your console unbanned. Contrary to popular belief, you can extract the nand.bin file from a non-banned console (red ringed that you might buy from let's say... Ebay for cheap), and then place the key information from the nand.bin on the non-banned console onto the one that is banned and it will again work on xbox live. It's been done.... many, many times. Google xbox 360 keyvault swap.
Guys if you are reading this, do not even think about if you've been playing online anytime soon! When the NXE update was released and YOU downloaded it so you could keep playing online then you cannot perform the keyvault swap anymore. This was possible through a security hole in the bios that WAS patched via NXE! I'm sorry if you were given false hope!

Why would anybody threaten this guys wife and dogs?? Even if its only a joke it cant be much fun for him and he has a job to do the same as anyone else.
We all play the game and take the risk of being banned

Some people just aren't mentally stable enough to handle losing $200 dollars of functionality in their systems. Those are the people who WILL ruin all of this for us. If the authorities see these people causing so much trouble then it will soon be noticed by political types who will try to make modding illegal!

but we dont know what made us fall.
its more like we were pushed

Yeah i agree with you there.
Lets hope this whole thing blows over and c4eva sorts the new firmware out before it all gets out of hand

We may not know exactly what caused us to fall at this point and time, but we will. Thats the point. We have to learn from this and continue.

We all knew the risk when we got into bed with this. It will always be a cat and mouse game, whether it's XBox modding, iPhone Jailbreaking, or anything else you may apply this to.
When my box was banned, I was not upset, I simply said " SHIT ~ It's their turn now " ( I may have vented later LOL but that was my initial reaction )
Yea, it sucks we can not play on live anymore, but there is still third party services we can use to play online, there is also the fact that this box can STILL play " " " BACKED UP Games

" " " It's xmas time, perfect time to ask for a new box to use for legit play.
The scene will fire back, it' only a matter of time - and time heals all wounds ( and bans )
