Protip: Don't create a Web site offering over 1,000 DS games for illegal download unless you're really sure you won't get caught. Yoshiaki Asagiri wasn't so careful, and now a Kyoto District court has brought a most swift and brutal retribution down upon him.

For breaking Japanese copyright law, Asagiri has been sentenced to two years in prison, and has been slapped with two fines worth $21,000 and $75,000. The presiding judge said that what Asagiri did "tramples" over the efforts of those who made the games he was ripping off. Fair enough, but I never did work out how you're meant to pay off a massive fine if you're in prison.

What do you make of this ruling? Was the judge too harsh, or was this Asagiri's fault for robbing the DS library so blatantly?

Yup, it was his fault for offering them for public download. That would be like someone offering up any other game console images for public download. It just screams come get me.

No doubt, that's by far one of the dumbest criminals I've ever seen. Although I did see someone selling Copied 360 games on craigslist the other day.

yeah,he not the most intelligent bloke in the world...but on a sunday in uk,you go to any carboot sale and you'll see a plethera of "copies"being sold blatantly
im not saying its right,just saying :shock:

I know what your saying sas67. There is a little place not to far from me that I call a flea market. It's basically a small trade center type thing. People bring in all kinds of stuff to sell. You can find any movie that you'd ever want for sale there. If they happen to run out, they will burn it for you on the spot. I've never bought any from them, and have not desire too. But I watched plenty buy them there. I've also seen my fair share of them getting busted by the Feds too. But just as soon as one gets busted, 2 more pop up in there place.

Is it ok to sell backup copies of Xbox 360 games and Wii games as long as you state that they must own the original copy of the game, you know like a disclaimer? There seems to be a fine line, a grey area in the law because you are allowed to mod your system to play backup games and you are allowed to have back up games if you own the original copy and if you sell the original copy you must destroy the backups with-in 24 hours.

I will never ,and have never sold a backup of any kind

iv never heard that we are allowed to "hack" a console to play bkups (any console) thats an infringement of the rules or contract between publisher & punter upon buying a console.

No:
You are allowed (By current UK Law) to have a backup of any digital media you own, you are however NOT allowed to breach copy protection methods to make/use such a backup.
Also you are NOT allowed to sell backups to other people regardless of if they have the original or not, as you are then making profit from works not your own.

The ruling made stating mod chips were not illegal, also stated that, that they will become illegal if you enabled them to circumvent copy potections, so the only console that has so far been truly covered by legal modding is the original xbox as you could mod that and NOT bypass copy protection, all other consoles, that feature is bypassed too.

I made no agreement before buying my console.
as soon as i payed my hard earned money it was mine.

The agreement is written in such a way that buy turning on the machine you have agreed to the term's, infact I think you have to manually agree on the 360 to get past all the welcome stuff.

well if they chose they can remove any of there crap
that i do not own.

As of right now i recede my consent and/or permission.
In fact i consider anything in my 360 that is not owned by me
I consider litter.

Yes the system is yours and you are allowed to do whatever you want to it. For example your can throw it out of a window and no one will care. You can piss on it while it's plugged in and no one will care. You can mod it to play backup games it's your property to do what you wanna do with it....however, what dude was talking about that you agreed to in the terms when you do the welcome stuff on you system...is the terms of xbox live. Xbox live is a totally different thing which is in fact governed by Satan (microsoft) and yes you have to agree to their terms to play online but do not have to agree to anything to use your system how you see fit offline. That being said if you violate their terms online by playing backups they can ban your console from playing online if they find out but they will not kick your door in and take you 360 from you! People give to much power to and act scared of Satan (microsoft)! I say screw them, I paid for my system so i'll do whatever I want with it point blank period!
