TiVo gets $200M from EchoStar due to patent violations

TiVo has been rewarded $200 million more in damages from EchoStar, as the two companies continue to face off in court over a patent infringement lawsuit.

"We are pleased by the court's ruling to impose a contempt sanctions of approximately $200 million against EchoStar for its continued violation of a court-ordered permanent injunction," TiVo said in a press statement.

TiVo has received more than $400 million from EchoStar, confirming analysts belief that the DVR technology is worth every last penny.

U.S. District Judge David Folsom awarded TiVo $200 million, citing EchoStar's statement that the infringement wasn't willful.

"We are pleased that the district court rejected TiVo's request to award a billion dollars in sanctions and that it found that any violation of the injunction was not willful. While we disagree that any amount of sanctions was warranted, the decision confirms our belief that we designed around TiVo's patent in good faith," Dish and EchoStar said in a statement. "We believe that we ultimately will prevail on appeal."

The $400 M collectively means $2.25 per month from each EchoStar DVR subscriber is given to TiVo. The number is better for EchoStar, however, as Dish Networks originally wanted $1 billion in copyright infringement penalties.

Even though EchoStar has to write a check for $200 million, it seems both sides are happy with the outcome dished out by Judge Folsom.
