Xbox LIVE BanHammer for Playing Forza 3 Early

>> It looks like Microsoft started banning users from Xbox LIVE for playing Forza 3 early (the game was leaked on the internet a few days ago). It's not the first time Microsoft puts out the BanHammer from playing leaked games and it will certainly not be the last time. For now it seems to be an Account BAN and not a Console BAN.

Here's a quote of the email banned users got from MS:
Notification of Permanent Suspension: Pre-release title play

This email is to notify you that your Xbox LIVE account privileges have been permanently suspended due to illegitimate pre-release title play.

Your conduct was brought to the attention of the LIVE Enforcement Team through the course of our operation of the service. The LIVE Enforcement Team has reviewed the complaints and other evidence regarding this content and determined it violates the Xbox LIVE Terms of Use and/or Code of Conduct. Because your conduct is in violation, the Xbox LIVE Enforcement Team has enacted this permanent suspension against your gamertag.

During your suspension, you will not be able to log into Xbox LIVE. Your Xbox LIVE privileges will not be reinstated.

Customer Support is not able to modify or provide any further details about your suspension.

Microsoft expects that all customers abide by the Code of Conduct. The Code of Conduct provides guidelines for appropriate behavior while using the service.

Since they are banning accounts they would know the MAC address of the xbox.
So they will most likely monitor that box and whatever accounts are on it.

PLUS --I think they figure they can get another 50$ out of them and hope to catch them again.

I had a guy come in the other day who got banned for forza he got a few day ban for playing "a pre release " and a email saying he was permantly banned

My Son Got The E-Mail today He Told Me that he never tried to use any of the online features of Forza 3. If he really didn't ,how did they determine he had played that game. Isn't that some kind of privacy issue or do lose privacy in terms of use contract for xbox live???!!!

even if he played the game off line the console (we believe) can/will
that some info
then when he does hook to live it will send its report and bang there you go they have the info.

this is the worst thing they have done
banning a name

Thanks CoFree , I realize most people don't like MS, dont get it I run xp pro on my pc but that doesn't give them right to any info stored in my system. Where do they get off with gathering info not used over live to ban accounts. Not whining but just thinking out loud. :x :x :x

I'm afraid to hook my 360 back up to LIVE now, lol. I'm PAL though, so used a different rip to the one seemingly causing these bans i believe?

Real shitty move to ban the tags though i have to say. I'm not even sure how legal that might be, given that lots of people will have used those tags to buy all sorts of DLC, arcade titles and whatnot. And now have no access to that stuff. Real shitty shitty move. Just ban the bloody consoles(that's probably already bricked 5 times in the past)

To get around the info being send to M$, safe your profile on a memorycard and use 2 consoles, 1 console for backups (never goes online) and the other for retail games. Apparently they don't get the info of the profile but like you said from the console when it connects to Live.

It's about as legal as you (and me) trampering with the consoles fw and making copies of copyright protected media ;)

Just got this link from another site. It looks like M$ banned a game reviewer because he played the copy given to him at a Forza press event...

the way M$ looks at it
right now the worst thing they could do is ban consoles

With the ps3 price drop
if they ban a console
the person is likely to by a ps3
