If it got out on a private tracker that someone was injecting code into games to make backups detectable on Live, they would be dealt with swiftly on a site like FTN. Their account on one site would be banned, and then all accounts with the same IP on other trackers. A lot of the same torrent staffers are on many sites. I'm not defending torrent sites, but some of the good private trackers are vigilant in keeping the wrong people from watching. Do you have any idea how hard invites are to come by for FTN? In theory you are right, if MS really wanted to they could get invites to all the exclusive private trackers, plant code into uploaded isos that made them detectable on Live and subsequently ban all the pirates on Live. In reality, it's far easier to reach a public tracker like isohunt or the pirate bay and post isos that are "tagged." Given Microsoft's track record, I'm banking they take the easier, less costly solution.

Yes, but let's not forget that a Live ban is not something that happens right when MS detects a modded box. They wait till they want to ban a console and that usually comes in waves. What I'm trying to say is that there would be no way for a moderator or tracker administrator to know which ISO caused the ban since it could be weeks or even months later that the ban hammer hits.

Maybe... but if waves of people are being banned playing the same game, it's pretty obvious. In general you are right though, MS isn't going to tip their hand. The only obvious bans have been people that got banned for playing games that leaked before their official release.
