well all you have to do is get a new console and recover you acc and you are back in the game.

Its unlikely a 'modder' will (once banned) just give up and say whatever. They will more than likely buy a new box and mod it.

The way MS bans from live stems back from the original xbox, back then having a modded box allowed you to cheat with your games by editing the actual game files.
From that point it makes sence, ban the hacked console not the user, after all it's easy to make a new live account.
Oh I'm also guessing that any live acount that does get banned and returns to live will be monitored very closly for a while too.

you only use your serial number when flashing to be able to identify your back up. this comes in handy if you flash more than one xbox so you don't mix the files up.
you can still get on xbox live if you use your serial number when flashing. microsoft authenticates with your 360 via ip address and then via your games, which is why we emphasize having good back ups. and with that you still run the risk of being detected. . .

Sorry, but your IP has nothing to do with it, I have 2 360's both on live, as far as MS can see they both share the same IP.
It's the unique serial in each 360 that get's logged by MS, also certain unique parts of a game disc get flagged, not the whole disc.
As stated the use of serial while flashing is just to keep track of firmware files nothing more, you could use
and it would still work, so long as each part after the command is less than 8 characters long you can use what you like.

the ip address has to play some role, that's how you get on live. . . now what actually happens that gets you banned im not versed in that. i know they not banning ya ip address but i believe it's the mac address which they have to hit via ya ip. . .

When your 360 "logs in" to XBL, the servers compare the serial number to a database. Usually it's just a simple check to see if that serial number is on the "banned" list or has had issues in the past. M$ can at will check your serial number against every serial number they have for 360's and if you somehow changed it, that 360 would probably get banned. It's not the MAC address as these things can be cloned. Also the 360 itself gives the option to use an alternate MAC.
