say that you back up your game or you have downloaded an iso or something from somewhere...now...you can't actually be caught unless you play these backups/downloads online right? and they just ban you they don't prosecute or any trash like that...i've play three titles already with ethernet cable not jacked into my 360 and i've heard rumors of ms not checking for firmware but disc/cd keys...but they can't really do that if i don't play on live correct...i supposed i may be over thinking this lol

I don't know exactly how Microsoft spots backups online, the best defense against getting caught is to always use the latest iXtreme firmware for your model DVD-ROM drive. It is not foolproof however, it's very much a cat and mouse game between the firmware coders and Xbox Live. The firmware coders have programs that monitor exactly what commands are sent to the 360 dvd drive, that is how they devise a strategy against having backups being detected on live. The best strategy is to have an unmodded console to play on live or to never boot backups on your 360 until after your drive is flashed with the latest iXtreme firmware. That is not 100% full proof. I'm sure that someone else can elaborate on the exact technical nature of how the firmware coders monitor commands sent to and from the 360 DVD-ROM drive.

well yes there have been people banned that have not play a backup on live.
most of us think the 360 logs the error then when it is hooked to live M$ gets the error report and bang your banned.
As of now if you have the latest firmware and a good backup, then things seem fine(for now)
By the way.
i would tell you ,you are taking a big risk playing downloaded games.
The best way is to make a backup of a in hand game that you dump your self.

there would be people crying all over if that had happened.
but then again you never know what big brother will do.

it's a funny thing right...it's usually the people who are caught sharing as opposed to the people who are just taking
