Lucky for me, I rented Mirrors Edge and still have an untouched Fallout 3..so I probably have enough to last me till it's safe

well some people have took the update and things are running fine "SO FAR"
There is a 2nd group of guys taking it this friday.
joebf99 is one of them.
so you just have to decide what/when you want to take it.

I don't know if I was the first in the US to take the update or not, but I accepted it as soon as my 360 told me it was available. It was somewhere around 2 AM when that happened. All is well with mine!

Sooo...does that mean I'm probably ok to take the update? I dont know how the bans usually hit..other than in waves...are they immediate with the update or like a week later...what?

so far the bans are from people playing bad backup.
i know in your case that is not going to be a problem,but they could start banning for some other reason.
man if you want to take it do it.
so far no one has said they have been banned after the update as far as i can find.
in the end its up to you.

I'm gunna risk..my box is on the verge of death anyway...I need a new one....won't be too horrible of a situation..especially since I can afford 200 dollars....

yeah man i mean if ur gonna get banned ur gonna get banned, really is no way out of it i mean if you played a bad backup it's logged.

but like cofree said u prolly are safe anway.

I say, if its on the virge of death, play it till the cpu pops Update it, experiment, what ever. Thats what I did with my box. Good thing I have two. My main one RROD'd after the update, but I don't blame the update. I'm going to try and fix it though.
